Roles and Responsibilities
- Review and lead the drafting of all commercial and/or contractual correspondence between GE and the Client, and GE and Partner, and to ensure that the project correspondence register is updated in a timely manner. Ensure that 100% of commercial/contractual correspondence from Owner, Consortium partner and subcontractors (through the Site Contract Manager) are replied to.
- Responsible for matters relating to Insurance encompassing all correspondences, communications, notifications and claim submissions with the insurer, and where required or necessary, to seek advice and support from the insurance specialist.
- Fully responsible for all commercial and legal aspects of the project including but not limited to commercial considerations in supply contracts. You will also support the sourcing department with drafting project related purchasing conditions (PRPC).
- Work closely with the Project Director and the Project Team on claim management. You shall lead the team's efforts to mitigate or pursue claims including contemporaneously obtaining and maintaining documentation, photos, meeting minutes, schedules, reports, information on customer, Partner or subcontractor delays, concurrent delays, excusable delays, Change Order entitlement, etc.
- To ensure that the necessary tools and processes (e.g. Unifier, eARS, PCDMS, Affinitext, Project Execution Plan, etc) are put into place and are updated regularly as per management requirements.
- To prepare a Contract Compliance Checklist identifying all obligations, specific requirements, notices, etc. in a tabular format for easy reference and monitoring. The table shall also identify the dates the respective actions are due and the personnel responsible for the execution of the relevant action. The PCM shall take ownership of these documents and update them on a monthly basis after consultation with all responsible stakeholder identified in the Contract Compliance Checklist.
- Identify in the Contract Compliance Checklist required actions and monitor those that are over-due, due within the next month, and subsequent months.
- To attend and participate all relevant meetings during execution phase involving Owner, Partner and/or other meetings including but not limited to risk and opportunities, change order meetings, management reviews, etc.
- Other official duties as may be assigned by the Project Director or Management from time to time.
Required Qualifications
- 10 years or more, experience in a contracts administration/contract management discipline in an international contracting environment, preferably in the Power/Energy or Oil and Gas industry and in large-scaled and complex Turnkey/EPC and Consortium structured contracts.
- Solid understanding of contract terms and law principles, relevant technical, financial, cost & project risk management principles.
- Demonstrated knowledge and experience relating to delay analysis techniques and methodologies, calculating and analyzing productivity losses, ability to interpret construction contracts, drawings and specifications.
- Strong presentation and negotiation skills at higher management level.
- Ability to demonstrate good people leadership, influencing and management skills including the ability to work independently and communicate effectively within and across all levels of project functional groups of diverse nationalities.
- Accomplished computer skills particularly in utilizing MS-Windows and Office applications (Excel, Word, PowerPoint), project management software, Primavera P6 and/or other equivalent construction industry related software.
- Ability to handle many complex issues concurrently.
- Excellent written and verbal communication skills in both English and Chinese languages.
- Ability to travel on business trip and to project site as and when required.
Desired Characteristics
- Master's Degree in Business Administration, Engineering, Legal or equivalent.
- Prime contract commercial experience (domestic and international).
- Construction claims negotiation experience.
- EPC Experience, preferably in the Power Industry or Oil & Gas Industry.
- Excellent communication.
