Job Purpose
- This role is responsible for ensuring that the operations of the business comply with internal compliance standards and local laws, regulations, industry code and standards. Focus to support the business in the area of business control, maintaining high ethical standards in the interactions with HCP, Government Officials, and Third Parties.
- Drive the robust implementation of Menarini Global Compliance Framework across departments within Menarini's affiliates assigned, while focusing on the identification and realisation of cross-department synergies and business partnership.
- This role is critical in fostering a culture of integrity, and mitigating risks related to ethical and compliance issues within markets assigned.
- This role will have the oversight of the markets assigned as a Cluster Compliance Officer.
Key responsibilities
Country Responsibilities:
- Drive and implement comprehensive ethics and compliance programs aligned with Menarini Global & Regional Compliance framework and strategy.
- Partner, advice and support country management team and internal stakeholders on the Compliance Program, and compliance requirements of Menarini's business partners.
- Lead and take ownership of the day-to-day, implementation, and localisation of Menarini's policies, standards, and controls relating to anti-bribery/ corruption, antitrust, data privacy, etc (Compliance Program) to prevent illegal, unethical, or improper conduct.
- Promote awareness of compliance obligations and ethical standards in alignment with local laws, regulations and codes and internal policies throughout the organization and across all employees regardless of level.
- Periodic reports/ updates to the General Managers within the cluster and local Management Committee through Compliance Committee meeting on the implementation and effectiveness of the Compliance Programme, local compliance risks, and risk management actions.
- Conduct effective monitoring program in accordance to Menarini Global Compliance monitoring framework to assess the effectiveness of the compliance program.
- Stay updated on industry code and regulatory changes and update local compliance SOPs in alignment with in-markets or Menarini requirements and standards and communicate to internal stakeholders.
- Conduct investigations related to ethical breaches or compliance violations under the direction of Regional Director, Ethics & Compliance. Perform root cause analysis and make appropriate recommendations to the stakeholders to address issues and ensure appropriate corrective measures are taken.
- Conduct Compliance Risk Assessments to determine high-risk areas for remedial action, third party due diligence and evaluation, and associated incident handling and remedial actions.
- Advise, support, and manage all local anti-bribery/corruption, data privacy, and compliance affairs relating to Menarini.
- Review and update policies & procedures and all relevant documentation for
completeness, standardisation and consistency with the Company's Code of Conduct,
Corporate Policies, Regional Policies & SOPs, as well as the local Country laws,
regulations and industry code, focusing on HCP, Government Officials and Third Parties
relations and engagement;
- Provide and coordinate all necessary trainings and employee awareness on compliance program and related industry developments, ensuring on-boarding and annual refreshers on compliance standards and business practices are conducted and completed on time;
- Responsible for all compliance activities which could include reviewing and identifying gaps of internal processes, documents & reports, and ensuring compliance with internal and external regulatory framework;
- Involvement in the process of Third-party due diligence together with relevant functions to ensure due diligence process is effectively implemented;
- Review audit findings and follow through on implementing the gaps and ensuring there is no repeated audit findings
Cluster Responsibilities:
- Ensure Global & Regional Compliance initiatives are properly cascaded and implemented within the cluster.
- Ensure review and adapt regional compliance policies to meet the specific legal and cultural contexts of each country in the cluster.
- Collaborate with in-market compliance officers and teams to share best practices and enhance compliance efforts across the organization.
- Recommend improvements to compliance policies and procedures based on audit findings and stakeholder feedback within the cluster, and implement tailored risk mitigation strategies for each country.
- Establish and review monitoring plan to proper monitor adherence to policies and procedures across the countries, ensuring consistency and effectiveness.
- Regular update to Cluster Vice President on the implementation progress of Compliance initiatives within the cluster and consolidate Compliance reports, which highlight risks, issues, and action plans across the cluster.
- Work closely with Regional Director, Ethics & Compliance and the team to ensure alignment and share best practices across jurisdictions.
- Perform other tasks and involved in Regional or Global project that may be assigned from time to time.
Qualifications and Experience
- Bachelor's degree (preferably in law, finance or business administration). Relevant certification (e.g., CCEP, CCO) preferred.
- Minimum 5 years in Ethics & Compliance, Audit or Internal Control. Preferably in a senior role. Experience in pharmaceutical/healthcare sector is a plus. Total years of working must not less than 15 years. Strong understanding of compliance regulations, ethical standards, and risk management within the markets of responsibilities will be an added advantage.
- Proficient in oral & written English;
- Computer literate (Word, Excel, PowerPoint);
- Strong communication & interpersonal skill, ability to deal with different levels within the organization;
- Proven track record of managing complex projects and leading cross-functional teams and influence without authority.
- High level of integrity and professional ethics.
- Ability to handle sensitive information with confidentiality.
- Experience with compliance software and tools is a plus.
